US Immigration Forms

Immigration is a process where a foreign individual moves to United States on a temporary basis or to live permanently. For a person to enter United States whether for a temporary visit or a permanent stay, a visa is required. A visa is a permit card for a non–citizen to travel or enter United States. A visa does not authorize a person to enter United States. Instead it permits the person to travel to United States. The entry into United States will be decided by the inspectors of Department of Homeland Security (DHS) , Customs and Border Protection (CBP) . These visas are classified into Immigrant Visa and Non- immigrant visa. Immigrant visas are used by people who wish to live permanently in US and Non- immigrant visas for people who wish to travel to United States on a temporary basis for business or for pleasure.

USCIS forms

There are various US Immigration forms available based on the need of the applicant. Below mentioned are few of the main US immigration forms.

Form I -140 – Immigrant Petition for Alien Worker
Form I- 90 – Application to Replace Green Card
Form I – 539 – Petition to Extend or Change Non-immigrant Status
Form I -130 – Petition for Alien Relative
Form I- 485 – Application to adjust the status

Form I -140:
If an immigrant must apply for an immigrant-visa based on employment, then he/she must use the form I-140 (Immigrant Petition for Alien Worker). If the employer wishes to sponsor a foreign citizen to work in the United States on a permanent basis, then the sponsor or the employer must file this petition on behalf of the foreign citizen.

Form I -90 :
Permanent residents whose Green Cards have already expired or is expiring, or card was lost, stolen or destroyed, mutilated, name or other biographic information has changed since the card was issued, have an old edition of the card or status has been automatically converted to permanent resident, must file this I90 petition to USCIS to obtain a new Green Card.

Form I – 539:
People who are already inside United States and wish to change their status from one non- immigrant status to another or to extend their stay, must file this petition to get their status extended or changed to another category.

Form I -130:
This form is used by a US Citizen or a Permanent Resident to sponsor their family member who wishes to enter United States . This form only helps a family member to immigrate to United States.

Form I- 485:
People who are in a different non – immigrant category who wishes to adjust their status to permanent resident must filer this petition to USCIS.

Based on the type of US immigration Forms or petition, the process of the petition is determined. If the applicant is from outside United States he must follow Consular Processing. If the application is filed within United States , all US immigration must be sent to USCIS for processing. The approval of the US immigration form will be determined by the eligibility of the applicant and the provision of the required documents. Once petition is approved applicants will be notified in writing.
